The UK government has announced indefinite extend the recognition of the CE marking for businesses. Companies can therefore continue to use the CE marking on the UK market indefinitely. For more information about CE marking, please check this page.

This is what The Guardian writes on their website about the use of the CE marking:

The UK will retain the EU’s product safety mark indefinitely, in the latest climbdown from proposed post-Brexit changes, after the government bowed to pressure from industry and manufacturers.”.

What does this mean for companies selling goods in the UK?

The deadline of the 31st December 2024 no longer exists and products can continue to be sold in the UK using the EU CE mark. This applies to the 18 regulations that fall under the Department for Business and Trade (DBT). These are:

  • Toys
  • Pyrotechnics
  • Recreational craft and personal watercraft
  • Simple pressure vessels
  • Electromagnetic compatibility
  • Non-automatic weighing instruments
  • Measuring instruments
  • Measuring container bottles
  • Lifts
  • Equipment for potentially explosive atmospheres (ATEX)
  • Radio equipment
  • Pressure equipment
  • Personal protective equipment (PPE)      
  • Gas appliances
  • Machinery
  • Equipment for use outdoors
  • Aerosols
  • Low voltage electrical equipment

There are different rules for other goods (including medical devices, construction products, transportable pressure equipment, rail products, marine equipment and ecodesign) and it is expected that the relevant departments covering these sectors will communicate their plans in due course. We will have to await developments but it seems the chances are that a similar approach may be adopted.

UKCA and CE marking

The UKCA marking is a new conformity marking that has been introduced by the UK government for products sold in Great Britain (England, Scotland, and Wales). It also applies to Northern Ireland, although there are some specific rules that apply there. The UKCA marking is similar to the CE marking in that it indicates that the product meets the necessary safety, health, and environmental protection standards. However, it applies only to products sold in the UK market.
